It doesn’t matter how long you have lived together or acted as though you were married, if you do not have a marriage license you will not be seen as married. There are instances you can ask for a judicial recognition of a relationships as a marriage.  You have to prove that you were in a relationship that the public assumed you could have been married. You have to file for this during your relationship or up to one year after the end day of the relationship.

I have been served with divorce papers, now what?

Once you have received the divorce petition time is of the essence, you must respond to the petition within 21 days. If you were served this petition and you were not in Utah the time you must respond in 30 days. If you do not respond then you have no input on the divorce and the court will proceed based on what was said in the petition.

Can I get joint custody of our pet in the event of a divorce?

Many states, including Utah view pets as property. This means that the pet will be given to one of you and there will be no custody or visitation agreement for the pet. You may be able to reach an agreement just the two of you, but the courts will not help you enforce the agreement you made. The person who gets the keep the pet in the event of a divorce is also not obligated to allow the other see the pet if they don’t want to.

Are the mothers guaranteed full child custody in Utah?

No, the courts do not base child custody based off the gender of the parent. If the parents are unmarried then the mother assumes automatic custody until the fathers has been named or establishes paternity. Often times the courts allow both parents to have some sort of child custody or visitation as that is typically what is best for the child.
